What are cookies

Cookies are strings of text that the sites visited by the user send to his terminal (usually the browser), where they are stored before being re-transmitted to the same sites on the next visit by the same user. While browsing a site, you can also receive cookies on your terminal that are sent from different sites or web servers (so-called "third parties"), on which they can reside

some elements (e.g. images, maps, sounds, specific links to pages of other domains) present on the site you are visiting.

Types of cookies

The EU cookie law and the general provision of the Guarantor Authority for the protection of personal data of 8 May 2015 "Identification of simplified procedures for the information and acquisition of consent for the use of cookies " identify two macro-categories: "technical" cookies and "profiling" cookies.

a) Technical cookies. They are those used for the sole purpose of "carrying out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide this service" .

They are not used for other purposes and are normally installed directly by the owner or manager of the website.

Within the definition of technical cookies, the legislator and the Guarantor Authority distinguish between various cases. There are navigation cookies or session cookies, which guarantee normal navigation and use of the website (allowing, for example, to make a purchase or authenticate to access restricted areas); analytics cookies, assimilated to technical cookies when used directly by the site manager to collect information, in aggregate form, on the number of users and how they visit the site; again, functionality cookies, which allow the user to navigate according to a series of selected criteria (for example, the language, the products selected for purchase) in order to improve the service rendered to the same.

These types of cookies receive a different regulatory framework than profiling cookies.

b) Profiling cookies. They are aimed at creating user profiles and are used to send advertising messages in line with the preferences expressed by the user while surfing the net. Due to the particular invasiveness that such devices can have in the private sphere of users, European and Italian legislation provides that the user must be adequately informed about their use and thus express their valid consent.

The Guarantor Authority for the protection of personal data in the aforementioned provision also contemplates "third-party" cookies, i.e. those cookies that come from other domains and which contain elements, such as ads or images, incorporated into the page.
